Koto no Besso/Villa in Kyoto Kyomachiya Nishijin Terms and Conditions

Article 1: Application

Lodging agreements entered by these facilities and agreements related to those are governed by the provisions set out in these terms and conditions. Any matters not set out in these terms and conditions are governed by laws and ordinances or customs.
These facilities may enter special agreements, regardless of the provisions of the previous Paragraph, to the extent that the special agreements do not contradict the spirit of these terms and conditions, or violate laws and ordinances or customs.
These facilities do not provide services other than lodging.

Article 2: Refusal to Provide Lodging

These facilities may refuse to provide lodging in the following cases.

When the request for lodging is not made in accordance with these terms and conditions.
When there is no extra space because all rooms are full or capacity has been reached.
When there are no extra rooms because all rooms are full or capacity has been reached.
When it has been judged that the party attempting to lodge may in the course of lodging commit an act that violates the provisions of laws and ordinances, public policy or standards of decency.
When it is apparent that the party attempting to lodge is carrying a communicable disease.
When special burdens related to lodging have been requested.
When it is impossible to provide lodging due to natural disasters, damage to facilities and other unavoidable reasons.
When it has been judged that the party attempting to lodge is intoxicated and will cause a significant disturbance to neighbors, or when a lodging party has said or done something to cause a significant disturbance to other lodging parties.
When a lodging party brings hazardous materials (gas heaters, firearms, petroleum, etc.) or physically harmful objects onto the premises.
When the situation falls under the provisions of Article 5 of the Enforcement Ordinance of the Kyoto Prefecture Hotel Business Law.
When the party attempting to lodge is someone who has had Article 11 applied to them in the past.

Article 3: Declaration of Names, etc.

(A) A party requesting a lodging agreement for these lodging facilities will declare the following information to these lodging facilities.

The lodging party’s address, name, telephone number, gender, nationality and occupation
Lodging dates, planned arrival time, company name, and telephone number and name of the requestor
Lodging fees
Other information deemed necessary by these lodging facilities

(B) When a lodging party requests during their stay to continue their stay past the lodging dates indicated in Item (2) of the previous Paragraph, and only when there are no reservations for these facilities, these facilities will consent to the request and handle the situation as though a request for a new lodging agreement was made upon receiving an advance payment for the lodging fees.

Article 4: Lodging Agreement Establishment, etc.

A lodging agreement is established when these facilities have accepted the request pursuant to Article 3 and confirmed payment of the application fee (equivalent to lodging fees) by deposit or by credit by the designated date. (Requestors are asked to bear transfer fees.) However, this does not apply to cases where these facilities prove that they have not accepted the request.
The application fee will be allotted toward the final lodging fees the lodging party is to pay. If a situation in which the provisions of Article 5 are applied occurs, the application fee will be allotted first toward penalties for breach of contract, followed by damages. Any remaining balance will be returned to the requestor.
The requestor’s request for lodging becomes invalid when the application fee set out in the previous Paragraph is not paid by the date designated by these facilities pursuant to the provisions of the previous Paragraph.
Reservations are accepted from the first of a given month for a period extending to the last day of the month two months after that month.

Article 5: Cancellation of Reservations

(A)When a requestor of a lodging reservation cancels all or part of the lodging reservation, these facilities will charge penalties for breach of contract according to the following Items.

The standard penalties for breach of contract are 100% of lodging fees for each lodging party for the first day when the requestor cancels on the day of lodging, 70% when the requestor cancels the previous day, and 50% when the requestor cancels in the period from two weeks prior to two days prior.
When a lodging party fails to arrive by 20:00 on the day of lodging without notification, or when the lodging party fails to contact these facilities before two hours have passed since their planned arrival time (with the limit at 20:00), these facilities may regard the lodging reservation as having been canceled by the requestor, and handle the situation accordingly.
When the number of days reserved is shortened, these facilities will receive a proportionate penalty for breach of contract based on one day’s lodging fees (the first day), regardless of the number of days the reservation was shortened.
When a reservation is regarded as canceled as set out in the previous Item, and the lodging party’s lack of contact or failure to arrive is proven to be attributable to the nonarrival or delay of a train, aircraft or other public transportation vehicle, or in some other way not attributable to the lodging party, these facilities will not charge penalties for breach of contract set out in Item 1.

Notes

The figures represent percentages of base lodging fees that constitute penalties for breach of contract.
When the number of days reserved is shortened, these facilities will receive a proportionate penalty for breach of contract based on one day’s lodging fees (the first day), regardless of the number of days the reservation was shortened.

Article 6: Right to Cancel Reservations

(A)These facilities may cancel lodging reservations in the following cases, except where set out otherwise.

When any of Article 2, Paragraphs 3 through 10 applies
When the information set out in Article 3, Paragraph 1 has not been declared
When an application fee demanded pursuant to Article 4 has not been paid by the deadline

(B)When these facilities cancel a lodging reservation pursuant to the provisions of the previous Paragraph, these facilities will return any reservation fees they had collected with regard to the reservation.

Article 7: Lodging Registration

(A)The lodging party will register the following Items at these facilities on the day of lodging.

The Items set out in Article 3, Paragraph 1, Item 1
Passport number, Japanese port of entry and date of entry into Japan if the lodging party is not a Japanese citizen
Departure date and time
Other information deemed necessary by these facilities

(B)The lodging party will pay fees set forth in Article 9 in advance or through a travel agency.

Article 8: Check-in and Checkout Times

Check-in time, which is the time at or after which the lodging party will check into these facilities, starts at 3:00 pm; checkout time, which is the time by which the lodging party will leave these facilities, is 11:00 am.
Under no circumstances do these facilities extend checkout time past 11:00 am.
When a lodging party stays for two or more consecutive days, they may use these facilities throughout the days (except their arrival day and departure day). However, room staff members will enter their rooms during the cleaning period of 11:00 am to 3:00 pm.

Article 11: Refusal of Continued Lodging

These facilities may refuse to allow a lodging party to continue to stay in the following cases, even in the midst of the period during which they are providing lodging.

When any of Article 2, Paragraphs 3 through 10 applies
When someone other than the lodging party enters their guest room
When a lodging party fails to follow the rules of use set out Article 10
When a lodging party smokes in bed in the bedroom or elsewhere, uses firefighting facilities or the like inappropriately, or otherwise commits an act prohibited in the rules of use set out by these facilities.

Article 12: Liability

The liability of these facilities regarding lodging begins when a lodging party registers their stay at these facilities or enters these facilities (whichever is earlier), and ends when the lodging party departs with the intent to vacate these facilities.
When these facilities become unable to provide a guest room to a lodging party due to reasons attributable to these facilities (and not when doing so is difficult due to natural disasters or other reasons), these facilities will arrange for the lodging party other lodging facilities that charge similar fees. In these cases, these facilities will not charge lodging fees for the days on which they were unable to continue to provide guest rooms.
In the case described in Paragraph 2 of this Article, these facilities are unable to bear liability for damages in excess of lodging fees.
This hotel has met fire-safety standards set out by the fire department, and has prepared all possible emergency facilities for the safety and security of their guests.
These facilities do not provide services other than lodging.

Article 14: Storage of Baggage and Personal Effects

These facilities cannot accept or store baggage and the like belonging to the lodging party in advance of their stay. (Please consult with us if you plan to arrive before check-in time on the day of lodging)
If a lodging party leaves behind their baggage or personal effects (including those left in safes) at these facilities after checking out, these facilities will store the items for seven days (counting from the day the items were discovered), and then deliver valuables to the nearest police station and dispose of all other items.

Remarks on Calculation of Lodging Fees

The only base lodging fee the lodging party is required to pay is the room fee.
There is no special rate for children.

Koto no Besso/Villa in Kyoto Kyomachiya Nishijin Rules of Use

In order to maintain the communality and safety of our facilities, we ask that guests who use these facilities obey the following rules of use in accordance with Article 10 of Kyomachiya Nishijin Terms and Conditions. If you do not obey these rules, we will refuse to allow you to continue your stay in accordance with Article 11 of the Kyomachiya Nishijin Terms and Conditions.

Do not use firearms or other objects that could cause fires within the facilities.
Smoking is not allowed inside any buildings within the facilities. Please smoke in the designated areas.
These facilities are wooden buildings in a residential neighborhood. Do not talk or sing loudly or behave boisterously, or do anything else that will annoy others or bother residents of the neighborhood.
Do not bring any of the following items into the facilities.
1. Animals, birds
2. Items that give off a strikingly foul odor
3. Unreasonably large volumes of articles
4. Gunpowder, gasoline and other flammable items
5. Illegally owned guns and bladed weapons
6. Marijuana, narcotics, stimulants and other drugs
Do not gamble or engage in disorderly conduct within these facilities.
Do not recklessly pull people into the facilities, or take fixtures, articles and the like from the facilities and move them to different locations, alter their appearances or use them for purposes other than their intended use.
Do not install foreign objects to the structures or equipment of the facilities, or move fixtures to other places within the facilities.
We do not allow people who are drunk to use the baths.
